Terms of Service

Please read these Terms of Service carefully before using Formpaste. By creating an account or using the Service, you agree to be bound by these terms.

Who We Are

Formpaste is operated by Search Ventures Pty Ltd (ACN 639 906 353), an Australian company (“we”, “us”, “our”). References to “Formpaste” or “the Service” refer to the platform accessible at formpaste.com and app.formpaste.com.

Definitions

  • Account - a unique account created to access the Service.
  • Free Plan - the no-cost tier with no expiry, subject to the submission limits published on our Pricing page.
  • Subscription - a paid plan granting access to additional features and higher submission limits.
  • You - the individual or organisation accessing or using the Service.

Acceptance of Terms

By creating an Account or using the Service, you confirm that:

  • You are at least 18 years old
  • You have read and agree to these Terms
  • Where you are acting on behalf of an organisation, you have authority to bind that organisation

Use of the Service

Permitted Use

You may use the Service to collect form submissions on websites you own or administer. You are responsible for ensuring that any data you collect through your forms is handled lawfully and that you have the necessary consent to process that information under applicable privacy laws, including the Privacy Act 1988 (Cth). Your use of the Service is also subject to our Acceptable Use Policy, which sets out permitted and prohibited uses in more detail.

Prohibited Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws or regulations
  • Upload data you do not have the right to use or publish
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell or sublicense access to the Service without our prior written consent

Accounts

You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account. Notify us immediately via our contact page if you suspect any unauthorised use of your Account.

We reserve the right to suspend or terminate Accounts that violate these Terms.

Subscriptions and Billing

Free Plan

The Free Plan is available indefinitely with no credit card required, subject to the submission limits published on our Pricing page. Features are limited compared to paid plans.

Pro is billed monthly or yearly, at your choice, across the submission-quota tiers described on our Pricing page. Prices are listed on our Pricing page and displayed in the currency shown at checkout. There is no free trial; your payment method is charged at the time you subscribe.

Payments are processed by Stripe, Inc. By subscribing, you also agree to Stripe’s Terms of Service. We do not store your full payment card details.

We reserve the right to change pricing with at least 30 days’ notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

Refunds

If you cancel within 7 days of your first paid charge and have not made material use of paid features, we will issue a full refund on request. Outside of this window, subscriptions are non-refundable, and you retain access to your paid plan until the end of the current billing period.

Data and Privacy

Your use of the Service is governed by our Privacy Policy. By using the Service, you agree to the collection and use of information as described therein. If you require a formal data processing agreement (for example, to cover data collected on your behalf through your forms), see our Data Processing Agreement.

You retain ownership of all submission data collected through the Service. We do not sell your data to third parties. We process your data solely to provide and improve the Service.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Search Ventures Pty Ltd. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

Termination

You may cancel your Account at any time from your dashboard settings. Upon cancellation, your Account will revert to the Free Plan at the end of the current billing period. Your data is retained and accessible; it is not automatically deleted on cancellation.

We may terminate or suspend your Account at any time, with or without notice, if we believe you have violated these Terms or if required to do so by law.

Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by agreement.

Limitation of Liability

To the maximum extent permitted by applicable law, Search Ventures Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
